1. Acceptance of Terms
By downloading or using SkyWrit ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
2. Description of Service
SkyWrit is a flight companion application that identifies geographic landmarks — mountains, cities, national parks, rivers, monuments — that may be visible from your airplane window based on your flight's route, altitude, and heading.
SkyWrit is designed for entertainment and geographic education only. It is not an aviation navigation tool, a safety system, or a substitute for any instrument used in flight operations.
3. Not for Navigation or Safety Use
SkyWrit must not be used for aviation navigation, flight planning, or any safety-critical purpose. The landmark positions, visibility calculations, and flight path data provided by the App are approximate and may be incorrect. Do not rely on SkyWrit to make decisions related to aircraft operation, safety, or emergency response.
SkyWrit is intended to be used by passengers in the cabin of a commercial aircraft as a passive entertainment and discovery tool.
4. Eligibility
You must be at least 13 years of age to use SkyWrit. By using the App you represent that you meet this requirement. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms.
5. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for personal, non-commercial purposes.
You may not:
- Copy, modify, or distribute the App
- Reverse engineer, decompile, or disassemble the App
- Use the App for any commercial purpose without our written consent
- Use the App to transmit harmful, illegal, or offensive content
6. Accuracy of Information
Landmark data, flight paths, and visibility calculations are provided on an "as-is" basis. We make no warranty that:
- Any specific landmark will actually be visible from your window
- Flight path data accurately reflects your actual route
- Weather or cloud cover estimates are accurate
- Landmark coordinates, names, or descriptions are free of errors
Geographic data is sourced from public datasets and may contain inaccuracies. Visibility calculations are mathematical approximations that do not account for all real-world variables (window placement, seat position, atmospheric conditions, etc.).
7. Connectivity and Offline Use
Some features of SkyWrit require an internet connection (flight resolution, downloading corridor packages for less common routes). Core landmark display functionality works offline for bundled routes. We do not guarantee that any network-dependent feature will be available at any given time.
8. Intellectual Property
All content, software, and data in the App — including but not limited to landmark databases, corridor packages, scoring algorithms, and visual design — are owned by or licensed to us and protected by applicable intellectual property laws.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11. Governing Law
These Terms are governed by the laws of the State of Connecticut, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Connecticut.
12. Changes to Terms
We may update these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the updated Terms.
